Advice For Dealing With Domestic Abuse

DJP Solicitors

If you know or suspect you have been a victim of domestic abuse and want out of the situation, separation and divorce are valid decisions to make. Here at DJP Solicitors, we can assist our clients with divorce and separation agreements.

Here is our advice on what to do if you have been a victim of domestic abuse.

What Counts As Domestic Abuse?

Domestic abuse can happen to people of all genders and can include:

  • Physical abuse

  • Sexual abuse

  • Psychological abuse

  • Emotional abuse

  • Violent or threatening behaviour

  • Controlling behaviour

  • Coercive behaviour

  • Economic abuse

  • Harassment

  • Stalking

What To Do If You Are A Victim

One of the first steps to do is to find somewhere safe to stay. This could be with relatives, friends, a refuge or renting your own space. It could also be in your own home, as long as you think you’re safe from your abuser there.

Refuges are places that provide a safe place to stay while you think about what to do next. They often have staff on hand trained to deal with victims of domestic abuse who can advise you on exactly what to do next.

Next you should report the situation to the police, as most police stations will have specially trained officers to help in these situations. They can then arrest, caution or charge the abuser.

Get Legal Protection

You can ask the court for help in keeping your partner away from you, through a non-molestation order or an occupation order. This can stop them from hurting you or make them stay away from your home.

You’ll then want to try and begin the process of being granted a divorce or a separation agreement. You might require expert advice on making you the sole owner of your home, sorting out child custody or ending your marriage.

If you don’t want your abuser to be at the court hearing, you can ask for special measures to prevent seeing them. This could involve giving evidence by video and ensuring you don’t arrive at the same time as them.
