Common Workplace Legal Disputes

Disagreements, arguments, and underlying tensions within the workplace are unfortunately very common, but incidents which spill over into legal disputes are thankfully much rarer. Often much more serious in nature, and triggered by unacceptable behaviour or conduct, legal action can have serious repercussions for both employer and employee. As leading local experts in the legal profession, let the team at DJP Solicitors guide you through the often complex world of workplace disputes - with legal issues as varied as discrimination, unacceptable working conditions and more.

Payment Disputes

Payment disputes can be a prevalent source of stress and worry, often causing a rift between an employee and boss. Be it a wage slip which appears sketchy, or a bonus payment which was promised but never delivered, monetary issues are of great importance, and you’ll likely want to clarify them sooner rather than later. Though there is strict legislation around employment contracts and related criteria, complex legal jargon may make wading through it difficult - which is where we come in. We offer in-person, video and telephone consultations when convenient.

Discrimination

Targeted discrimination can leave an individual feeling isolated and violated, especially in a crowded workplace or supposedly ‘professional’ environment. If a protected characteristic of yours has been attacked, either due to a single comment or continual bullying, you may be able to take legal action. Racism, ableism, gender and age-related discrimination are all unfortunately still rife in 2023, and even something as subtle as an employer failing to make reasonable adjustments for you could merit legal action.

Workplace Safety

A disregard for workplace safety is more noteworthy in some environments than others, with busy warehouses and construction sites of course requiring additional measures compared to (for example) an office, hospitality environment or retail setting. The provision of Personal Protective Equipment (PPE) is compulsory for employers in many instances, with a workforce sufficiently protected with headwear, eyewear or durable specially-crafted attire. Even the use of precautionary measures such as wet floor signs can be considered important when preventing injury in otherwise safe settings.

Unfair Dismissal

Unfair dismissal is one of the most common reasons for an employment tribunal taking place, and is triggered when an employer terminates an employee’s contract without a fair reason to do so. Unfair dismissal can be claimed by any employee in these circumstances, most frequently if the employer had a fair reason but handled the dismissal using an incorrect procedure. The Employment Rights Act 1996 states that employees are entitled to a fair reason before being dismissed, and if this wasn’t the case with your dismissal, we’re on-hand to provide advice and representation.
