When it comes to resolving disputes, our legal system is designed to make sure that everyone has a fair chance to put their case forward, whether the topic of debate is a divorce settlement or a land ownership conflict. In Scotland, these disputes are divided into the categories of civil and criminal cases. Civil cases describe disputes between two or more parties, where these parties may be individuals or organisations. Conversely, criminal cases are when charges are brought directly against an individual or organisation.
There are numerous different types of civil court in Scotland that are dedicated to handling various kinds of disputes. Read on to find out more about these different courts and the kinds of cases they tend to handle.
Sheriff Court
In Scotland, sheriff courts handle numerous different types of civil cases, where the sheriff in question is typically a qualified solicitor or advocate. Various examples of civil action that these courts deal with include family disputes such as divorce and adoption, personal injury claims and discrimination cases.
All-Scotland Personal Injury Court
This branch of civil court is solely dedicated to handling eligible personal injury claims. A case would be eligible if the claim exceeds £5000 or if it is a workplace-related injury case worth £1000 or more.

This is the highest civil court in Scotland that typically hears cases worth £100,000 or more. The Court of Session is made up of two key branches. The Outer House deals with complex divorce cases and large financial claims, whilst the Inner House deals with appeals against decisions made in the Sheriff Appeal Court or in the Outer House.
