  • Drafting the Agreement: Once the terms are agreed upon, the employer usually drafts the settlement agreement. This document will outline the terms of the settlement, including the financial compensation, any additional benefits, and the specific claims being waived by the employee.

  • Independent Legal Advice: For a settlement agreement to be legally binding under Scottish law, the employee must seek independent legal advice.
